Welcome to saraknoll.com. The website, which serves as an information platform dealing with the artist and her works, enables you to receive an impression of the sculptures and paintings created by Sara Knoll. It also serves as an online shop where her works are sold.

Before making a purchase through the website or performing any other action, you are asked to read the Terms of Use set forth below. Making a purchase on the website is conditional on your acceptance of all the terms and conditions contained in these Terms of Use. We therefore recommend that you read them carefully.

The Website Terms of Use are written in the masculine form solely for the sake of convenience and obviously refer to women and men alike.
 

Definitions

1.    The saraknoll.com website (hereinafter: the "Website") is, as aforesaid, an online shop for the purchase of products and services by Internet users, in addition to being a platform where users can receive an impression of the art and work of the artist, Sara Knoll.

2.    The owner of the Website is Ms. Sara Knoll (hereinafter: "Sara Knoll" or the "Website Owner") and she has sole ownership of it. The Website is also managed by her or by someone acting on her behalf (hereinafter: the "Website Management").

3.    An action on the Website is any act performed on the Website, including the purchase of products and/or services offered on the Website (hereinafter: an "Action").

4.    The provisions of these Terms of Use shall apply to every Action performed by the Website "User" as defined below.

5.    Products – all the items offered for sale on the Website – limited editions of artwork, paintings, sculptures, etc.

6.    User – including a customer/website visitor/company.

7.    Order date - the date on which the transaction was approved by the credit card company submitted by the User and/or by PayPal.

8.    Order confirmation – comprises the invoice together with the details of the purchase transaction.

9.    Shipping address – the address entered by the User on the order form as the address to which the order should be shipped.

10.    Requested date of delivery – the date entered by the User as the date he prefers that the product be delivered to him.

11.    Delivery date – the day on which the merchandise was delivered to its requested destination.

12.    Business days – weekdays, Sunday to Thursday, excluding Friday, Saturday, holiday eves, holidays and intermediate festival days.

 

General

13.    All the works of art, services and information on the Website are subject to the conditions set forth below. Use of the Website and/or purchase of a product offered for sale by the Website constitutes confirmation by the User that he has read these Terms of Use and agrees to all the provisions of these Terms of Use and will act in accordance with them, and that he, or anyone acting on his behalf, shall have no grievance and/or demand and/or claim of any type or kind against Sara Knoll and/or anyone acting on her behalf and/or the Website Management in all that concerns the provisions and conditions of these Terms of Use.

14.    Accordingly, if you do not accept any of these Terms of Use, you are requested not to make any use of the Website.

15.    These Terms of Use apply to the use of the Website and the services contained therein, accessed by means of any computer or any other communication device (such as a mobile phone, different kinds of computer tablets and any other electronic device). They also apply to the use of the Website whether over the Internet or whether through any other communication medium.

16.    Sara Knoll and/or the Website Management does not undertake to maintain a stock of all the models and/or images on the Website.

17.    The images on the Website are for illustrative purposes only and, to the extent possible, the Website Management will attempt to do the utmost to display an accurate picture of the product.

18.    The Website Management does its best to present the most complete and most comprehensive information regarding the product, including images. Notwithstanding the foregoing in this section, it should be clarified that in good faith and/or without any intent to deceive, inaccuracies or errors may appear on the Website, and the Website and its owner shall not bear any liability arising out of those inaccuracies or errors.

19.    The prices of the products on the Website include VAT in accordance with the law.

20.    The computer entries made by the Website Management concerning the Actions carried out through the Website shall constitute prima facie evidence of the accuracy of the Actions.

21.    Sara Knoll reserves the right, at any time, to modify the Website Terms of Use by updating this document. The User will be bound by that modification for all intents and purposes.

22.    From time to time, Sara Knoll and/or anyone acting on her behalf reserves the right to modify the information contained in the Website without prior notice, and the User shall have no grievance, claim and/or demand against Sara Knoll and/or anyone acting on her behalf due to the introduction of such modifications and/or any malfunctions that may occur as a result of their introduction.

Furthermore, Ms. Sara Knoll's studio is located on 57 Zayin Cheshvan Street in Ramat Hasharon, Israel.

 

Making a Purchase on the Website

24.    Among other things, the Website enables the selection and purchase of items among the items appearing on the Website in an easy, convenient and expeditious manner.

25.    An 'item page' will be displayed for every item or service offered on the Website, containing details pertaining to the offered item or service as well as the sales price (hereinafter: the "Item Page").

26.    Please note that, from time to time, the Website Management reserves the right to update the Item Page, add or withdraw information, remove artwork no longer in stock, and add colors and/or sizes, in addition to updating and/or making changes to the prices of the items from time to time.

27.    The prices displayed on the Website include VAT in accordance with the law unless expressly stated otherwise.

28.    To make a purchase on the Website, the User will be asked to enter basic information, such as his name, home address, email address, telephone number, credit card number and shipping address.

29.    Payments made on the Website are secured through the company Pelecard, which utilizes SSL technology and is a Level I merchant compliant with the PCI Security Standard, through which credit card payments can be made. Payments can also be made through PayPal.

30.    To expedite the flawless processing of the order, the User must make sure to provide accurate information. Otherwise, the Website Management will not be able to ensure the processing of the order.

31.    Furthermore, the information submitted by the User on the Website will be utilized, among other things, to send emails regarding special discounts or updates on the Website, subject to obtaining approval from the User to do so.

32.    When the order is placed, the Website Management will verify the credit card information and following approval of the charge by the credit card company, the User will be sent appropriate notification that the order has been approved. It should be clarified that only after such notification is sent will the transaction be deemed an order.

33.     It should be clarified that the User's credit card will be charged for the cost of the item he purchased as soon as the processing of the order is completed. The items purchased through the Website (namely, the User placed an order and it was approved) will be referred to below as the "Items."

 

Supplying the Works of Art

34.    The paintings displayed on the Website are original paintings (with no reproductions).

35.    The sculptures displayed on the Website can be recast and up to 12 reproductions can be made from each sculpture, if needed and in accordance with the requirements of the User.

36.    All the sculptures on the Website are signed and dated by the artist, Sara Knoll.

37.    The User receives a certificate of authenticity for each work, which is issued by Sara Knoll.

38.    After selecting a work of art / entering all the required information, you will be asked to choose a shipment option from among the given ones.

39.    If for any reason the transaction is not approved, within a reasonable amount of time the User will be sent an email message concerning the cancellation of the order.

40.    We recommend that you contact Sara Knoll through any of the channels if there is any doubt regarding the order and/or the shipment.

41.    The User can choose to have the ordered Items shipped directly to his home and/or to any other destination of his choice, contingent on the destination being within the delivery range defined by the Website Management.

42.    The Website Management will supply the Items to the User through an outside shipping company (hereinafter: the "Shipping Company"). The Items will be delivered by the Shipping Company within a few days of the placement of the order on the Website (up to 14 business days if the purchase was made in Israel).

43.    The delivery of the artwork will be free of charge to the User if his preferred shipping address is located in the Central or Sharon regions of Israel.

44.    After scheduling an appointment, the works can be collected from Sara Knoll's studio at no cost.

45.    Should the User's preferred shipping address be located in a different part of the country, excluding areas to which access is restricted due to security considerations and to which deliveries are not available, the delivery cost will be cited when purchasing the artwork.

46.    The delivery of the artwork to other countries will be made in accordance with shipments to those countries, with the cost varying depending on the preferred country. The shipment costs to a country that is not Israel will be agreed upon between the User and Sara Knoll or anyone acting on her behalf.

47.    Shipments made through the Shipping Company will be scheduled in advance prior to delivering the product. The orders will be delivered by a courier service that provides shipping services.

48.    The Website Management is not responsible for any act and/or omission on the part of the Shipping Company, including a delay in delivery. Items will not be delivered on Fridays, Saturdays, holiday eves and holidays.

49.    The Website Management is not obligated to supply the Items to areas to which access is restricted due to security or other considerations, or to countries that are outside the delivery range.

50.    The delivery of Items to the User's home or to any other destination of the User's choice entails a shipping fee as specified on the Website (hereinafter: "Shipping Fee"). The Shipping Fee will be added to the price of the Items quoted on the Website unless it has been determined that the User qualifies for free delivery.

51.    Sculptures in stock will be supplied according to the terms cited at the time of purchase. If the sculpture is out of stock, the delivery time will range between 3 to 4 months, which is the approximate time needed to cast a sculpture.

52.    Upon receipt of the Item, the User is required to verify the good condition and integrity of the ordered Item on the delivery date. Should the Item arrive in good condition and devoid of any damage, the User is required to sign that he received the Item intact and do so in the presence of the courier company. After the User attests to that, the Website Management shall bear no liability for any damage to and/or defect in the Item that was received. 

53.    Should the Item arrive in the home of the User with a defect or damage, the User must refuse to sign that he received an intact Item and point out the defect to the courier company. Should that be the situation, and if an actual defect was found in the Item, the Item will be replaced or repaired in accordance with the wishes of the User, conditional on it being feasible. If it is not possible to supply the Item to the User due to the defect, the User will be reimbursed for the cost of the Item and will be charged only for the transaction cancellation costs.

54.    When sending the Items, all of them are securely wrapped and packaged in order to prevent possible damages. For more information about the way in which the Items are sent, please contact the Website Management/Sara Knoll.

 

Cancellation of a Purchase Transaction by the User

55.    If you are not satisfied with the Item you received and wish to return it and get your money back, your money will be reimbursed in full within 14 days of the return of the product. The manner of reimbursement – your credit card will be credited.

56.    You must communicate your wish to return the product no later than 14 days after receiving the product.

57.    An exchange/ return will not be possible and no credit will be given for a product that was in any way damaged and/or for a product that any use was made of. A credit will be given provided that the product is returned unused and/or unimpaired and/or damage free – just as it was received. It should be clarified that the Website Management has the sole discretion to determine the condition of the returned product.

58.    The User may cancel a transaction he made on the Website in accordance with the provisions of the Israeli Consumer Protection Law, 5741-1981 (hereinafter: "Consumer Protection Law") or, alternatively, exchange the product for another product of equivalent value or receive a credit, all as specified below:

59.    If the product was manufactured especially for the User, namely was custom made for the User, the User will not be entitled to a refund or an exchange.

60.    As regards a defect in the product, if the User did not notify the Website Management about a defect in the product, at the time the product was received as specified above, this will constitute notification that the product is free of any defect and the User shall not have any grievance against the Website Management in the matter of any defect in the product.

61.    A credit to the credit card and/or to the PayPal account used when placing the order, less a cancellation fee of 5% of the value of the transaction or NIS 100, whichever is lower, pursuant to the Law, will be made to the User's credit card and/or PayPal account in line with the policies of the credit card company and PayPal.

Cancellation of a Purchase Transaction by Sara Knoll or Anyone Acting on Her Behalf

63.    The Website Management reserves the right to terminate, at any time and at its sole discretion, the activity on the Website and/or cancel a purchase transaction made by the User, including, but not limited to, each of the following instances:

64.    If following the completion of the purchase transaction it comes to light that the item is not in stock.

65.    If it comes to light that an error has occurred, either in the price of the product or in the description of the product on the Website.

66.    If the User's credit card details and complete contact information were not entered into the system.

67.    If following the completion of the transaction the User does not accept one of the terms of the transaction and/or shipment.

68.    If the User cannot be reached through the contact information he submitted and/or did not provide essential information needed for completing the transaction properly.

69.    In any instance where an act was carried out contrary to these Terms of Use, the User committed an illegal act and/or violated the provisions of the law.

70.    If when making the purchase transaction and/or following its completion, the User provided erroneous information.

71.    If the User committed an act or omission that could adversely affect Sara Knoll and/or anyone acting on her behalf and/or the normal operation of the Website and/or any other third party.

72.    If the Website Management is of the opinion that the User intends to resell the Items he purchased through the Website to a third party.

73.    In the case of force majeure, an act of war, hostilities or terrorism, a state of emergency and/or any other event that could prevent the fulfillment of a normal sale.

74.    In this section, "force majeure" means: including computer malfunctions, malfunctions in the telephone system or malfunctions in other communication systems, any sabotage security-related incident.

75.    Under the aforementioned circumstances, the Website Management may cancel the transaction or offer the User an alternative item equivalent in value, at the discretion of the Website Management and based on the circumstances of the cancellation.

76.    If a transaction has been cancelled due to any of the above reasons, the Website Management shall bear no liability, nor in any event shall it bear the cost of any direct, indirect, consequential or special damage incurred by the User or by a third party, including, but not limited to, damage arising out of purchasing the product and/or the service from a third party at a higher price.

77.    The User knows and acknowledges that although there are Items on the Website that are offered for sale as one-of-a-kind, and accordingly that two Items of the same kind will be not be sold, it is possible that an item appearing on the Website has already been purchased and/or ordered by another customer and that the information has not yet been updated on the Website. The buyer confirms that under such circumstances he understands that Sara Knoll will not supply the item to the buyer and/or to the User who is second in time. and that he will have no grievance and/or demand against Sara Knoll and/or anyone acting on her behalf with respect to this matter.

78.    Notification regarding the cancellation of the order will be given to the buyer by phone and/or by email to the address properly entered on the Website.

79.    The outcomes of the cancellation do not detract from the right of Sara Knoll and/or the Website to claim their damages because the value of the product decreased significantly due its condition following its return.

 

Website Liability

80.    The images on the Website are for illustrative purposes only. The information and the products contained on the Website may inadvertently include inaccuracies or typographical errors. Furthermore, the photographs of products are for illustrative purposes only and may not necessarily correspond to the actual products.

81.    A typographical error in the description of the product shall not be binding on the Website and/or the Website Management and/or anyone acting on their behalf.

82.    Sara Knoll and/or the Website Management and/or the Website and/or anyone acting on their behalf shall bear no liability for any direct, indirect, consequential or special damage incurred by the User and/or website visitor and/or third party resulting from a purchase made on the Website or resulting from a purchase made through the Website that is not according to these Terms of Use, regardless of the grounds for the claim – including a loss of income and/or prevention of profit caused for any reason whatsoever, in which case Sara Knoll /the Website Management reserves the right to cancel a specific order. 

83.    Under no circumstances shall Sara Knoll and/or anyone acting on her behalf bear any liability for any direct or indirect damage, punitive damages, incidental, special or consequential damage, and/or any other type or kind of damage, including, and without prejudice to the generality of the foregoing, punitive damages arising out of the use of the Website products, supply or non-supply of services and products, and/or those stemming in any other way from the use of the Website, whether based on an agreement or on damages, whether by reason of absolute liability and/or any other grounds, even if the Website Management or anyone acting on its behalf becomes aware of the possibility of such punitive damages.

84.    There may differences in the look, shade, size, etc. of the product as displayed on the Website compared to the actual product. In no way does this impose any liability on the Website Management or anyone acting on its behalf.

85.    Due to obvious technological reasons, the colors which the User sees on the screen may differ from the colors in the picture, poster or painting that he actually receives. The differences are typically minor and depend on the quality of the User's computer monitor. The Website Management does the utmost to supply first-rate products, but it is hereby clarified that it will not replace a product because the colors are not identical to the colors and texture viewed by the User.

86.    The Website Management does the utmost to provide its customers with smooth-running and high-standard service. Nevertheless, the Website Management cannot guarantee that the service will be not interrupted, will operate securely and error-free, and that it will be resistant to unauthorized access to the computers used by the Website Management, damages, breakdowns, malfunctions or failures – including malfunctions in hardware or software or in the communication lines to the Website – installed at the Website Management or at any of its suppliers. In any event, the Website Management shall not bear any liability.

87.    In any event, the Website Management shall not bear any liability in excess of the value of the purchased product nor any other damage.

88.    Sara Knoll is not liable for the use that will be made of the product by the User and/or order recipient, including its cleaning or any other use.

89.    The Website Management will have fulfilled its responsibility upon delivery of the ordered products to the shipping address entered at the time of the order.

90.    In the event that you purchased a defective product, your sole right is to exchange it or receive a refund for its value, pursuant to the conditions set forth in these Terms of Use and pursuant to the law.

91.    The Website Management shall not bear any liability for any damage you incur as a result of a delivery delay or as a result of the products supplied to you being defective.

 

Copyrights

92.    The content appearing on this Website includes texts and images that are the sole possession and property of Sara Knoll.

93.    It is prohibited to copy, reproduce, publish, transmit store the content in any form, in part or in full, without obtaining the written prior consent of Sara Knoll. It is explicitly clarified that any copying (including digital), distribution and sale of the pictures sold on the Website is strictly forbidden.

94.    All the intellectual property rights to all the content on the Website, including trademarks and copyrights, are the sole property of Sara Knoll.

95.    No commercial use may be made of the data published on the Website, of the Website database, of the lists and pictures appearing therein or of other information posted by and/or on behalf of the Website Management without obtaining the written prior consent of Sara Knoll.

96.    All textual content, icons, information and/or displays appearing on the Website, including graphics, designs, textual representations, trademarks or logos, in addition to their editing and presentation, are the sole property of Sara Knoll. 

97.    It is prohibited to copy and make use, or enable others to make use, in any other manner, of the content on the Website, including on other websites, in electronic publications or in printed materials, etc. for any other purpose, whether by you or by a third party or in collaboration with a third party, in any manner or means, whether electronic or mechanical or optical, photography and recording devices or any other means and/or in another manner without first obtaining the consent of Sara Knoll.

 

Revisions to the Terms of Use

98.    From time to time, the Website Management may modify the Terms of Use or any one of the Terms of Use of the Website by posting a revised version on the Website. The revised version will be effective immediately upon posting it.

 

Governing Law and Jurisdiction

99.    The law that applies to these Terms of Use and/or to any action and/or conflict deriving from them, is solely the Israeli law. In the event of any dispute, the courts in Tel Aviv-Yafo shall have the sole authority to adjudicate any dispute that arises, directly or indirectly, out of the provisions of these Terms of Use and/or the use of the Website and/or purchases made on it.

 

Protection of Privacy Law

100.    In order to purchase one or more of the artworks, you are required to submit personal information. That information is transmitted to the Website Management.

101.    The Website Management undertakes not to make use of the personal information of the Users registered on the Website except for purposes associated with the operation of the Website and the fulfillment of the purchase, with everything that entails.

102.    Pursuant to the Protection of Privacy Law, 5741-1981, a website visitor is entitled to view information if that information is stored in a database as defined in the law. The information that has been collected about you by the Website operators as part of a specific Action or by way of it, is subject to this law and, accordingly, to all the rights and demands of a visitor and to whom it may concern, pursuant to any law.

103.    When making use of the Website, information may be collected about the User-visitor, his browsing habits on the Website, services and products he has purchased to date on the Website, offers and services, advertisements and his areas of interest, products he asked to buy or sell, information pages he visited, registration for special services that require registration, and offers and services that were of interest to him. The visitor is not obligated to provide any information and access the Website or enable the collection of information about him. However, by accessing the Website, he agrees to the collection of the information subject to its permissible use pursuant to the provisions of any law. With regard to certain services, he may not be able to access the Website and enjoy those services without providing the information.

104.    To the extent possible, the Website Management takes all the accepted precautionary measures in order to safeguard the confidentiality of the information.

105.    The Website Management will not disclose any personal information provided by the User to third parties, unless presented with an order issued by an authorized agency or in any case of a violation of the Terms of Use or for legal purposes should they be required by law.

106.    Notwithstanding the above, it is hereby clarified that the transmission of information over the Internet could by read and captured by others, and the Website Management is not liable for any malfunction and/or data breach that could result in the exposure of the User's personal information and/or other information, but will do the utmost to prevent it.
